Homestead Act Savings Calculator
How much of your home equity is protected by Homestead law?
In Massachusetts, New Hampshire, and Maine, state Homestead laws protect a portion of your home equity from most creditors. The amount depends on your state, your marital status, and (in MA) whether you have filed a declared homestead. Enter your numbers below.
Homestead protection has carve-outs (mortgage holders, IRS, court-ordered child support, voluntarily encumbered debts). The figures above are general. For specifics on your situation, consult an attorney or talk to GoldCoast.
What the Homestead Act actually does
The Homestead Act in Massachusetts, New Hampshire, and Maine shields a portion of your primary residence equity from most creditors. If you are sued and lose, or you go through bankruptcy, the protected portion of your home equity is generally beyond a creditor’s reach. The protection does not apply to mortgages, IRS debts, court-ordered child support, or any debt you voluntarily secured against the property.
Why filing a declared homestead in Massachusetts matters
In Massachusetts, every primary residence automatically has $125,000 of equity protected the moment you take title. That is the automatic homestead. But you can file a Declaration of Homestead at your Registry of Deeds, which raises the protection to $500,000. The filing fee is about $35. The form takes 15 minutes. The decision usually pays for itself the moment you cross $125,000 in equity, which most MA homeowners do within a few years.
New Hampshire and Maine specifics
New Hampshire protects $120,000 per individual owner, doubled to $240,000 for married couples who jointly own the home. There is no declared-homestead step in NH. Maine protects $80,000 per individual owner. Married couples each get their own $80,000 if both are on the deed.
What this calculator does not include
The numbers above assume general homestead applies. Specific exemptions, carve-outs, and pending changes in state law can shift this. For a binding read on your situation, talk to an attorney. For the mortgage side, including how to position equity for the kind of protection that helps you, talk to GoldCoast.
